Border barriers
- $1.375 billion in funds, all for projects in the Rio Grande Valley. sounds like an increase to me
- This would fund 55 miles of barriers, partly on land and partly on levees because of what is left there.
- Those barriers canāt be built in several parks or nature reserves, including the National Butterfly Center.
- The Department of Homeland Security must consult with several small cities that are in line for new fencing about designs ā at least until Sept. 30, 2019.
Border/customs agents
- Funds 200 border patrol agents who were hired earlier this year.
- Does not fund new border patrol agents for the rest of the year.
- Funds 600 new customs agents for this year. The bill also funds additional recruiting to help fill some 600 open slots. sounds like an increase to me
- Total new customs agents: the goal is 1,200.
U.S. Immigration and Customs Enforcement (ICE)
- ICE gets 112 new health staff at detention facilities. Sounds like an increase to me
- Requires agency to file weekly reports on detainees and a monthly report on family separations and minor referrals.
- An increase of $95 million over last year for ācustody operationsā (a 3 percent increase over last year). Oh another increase
Immigration courts
- Funding for 50 new judges over last yearās amount. oh another increase
- Priority for hiring must be in highest workload areas.
If they are already appropriated to border security, then why would Trump need to declare an national emergency to use them? It doesnāt make sense?
Ahh, but the devil is in the details. The poison pills will all but ensure the 55 miles of fencing will never be built.

I actually agree with you there. In my mind, Trump could have used those funds without declaring a national emergency; unless Iām mistaken.

CBP could have used those funds. The executive branch has nothing to do with it. Itās not an national emergency if funds you appropriated arenāt being used in a timely matter. He should take that up with the head of that agency. He had 2 years to figure this out.

If they thought they could make a legal or constitutional case to do so they would have already done it or would do it in the future regardless of what Trump does or doesnāt do. But I think you will find removing Americans rights or property under an emergency declaration a tad more difficult to get by the courts than defending the nations borders from foreign nationals.
Tough luck, Presidents have broad discretion in what constitutes a national security emergency. Neither you, congress or the courts gets to make that determination, he does.

Once again you are making stuff up. The funds in question are border funds and Drug enforcement funds. Those funds were appropriated to be used for those purposes. It is up to the executive branch to decide how they will be specifically used, within that appropriation. In the past, this would have been done with no fanfare. But this is Trump, and he canāt be allowed to do anything because he isnāt a legitimate President.
They can only use funds NOT ALREADY SPENT. So, if I am following YOUR justification here, it would be the executive branch declaring an emergency to use unspent funds in CBP. Why is that an emergency? The Executive branch had 2 years to work directly with CBP to use those funds wisely.
