There are some very specific federal laws that apply to tampering with dairy products as well so the US Atty for LA needs to also file charges.
There are also federal anti tampering laws that apply to all foods and drugs.

Later the e-mail opines, “Michele (sic) Obama clearly has a chip on her shoulder. Not only does she see separate black and white societies in America, but she elevates black over white in her world.”
But nowhere in the thesis does Michelle Obama write the words “crime and hatred” or that whites are “ineradicably racist.”
A Florida mom who stood nearby as her daughter allegedly licked a tongue depressor at a doctor’s office — and then put it back in a jar — is facing a felony charge in connection with the revolting act.
Cori E. Ward, 30, of Jacksonville, appeared in court Friday on one count of tampering with a consumer product without regard for possible death or injury after she was arrested Thursday in connection with the now-viral Snapchat footage, WJXX reports.
A judge set Ward’s bail at $2,500 during her initial court appearance Friday and ordered her to stay off social media and not to contact anyone at the All Kids and Families Medical Center in Jacksonville, where she recorded the clip Tuesday while waiting inside an examination room with her 10-year-old daughter, according to an arrest report obtained by the Florida Times-Union.
“PLEASE DO NOT TOUCH MEDICAL SUPPLIES!” a message above the tongue depressors read, the video shows. “THANK YOU!”
A hand then removes the lid of the tongue depressor jar before a young girl whose face is blurred appears to lick the wooden stick before putting it back in a jar.
“Don’t tell me how to live my life,” a caption on the video reads.
The video was later posted to Facebook and eventually caught the attention of authorities. It has since been removed, WJXX reports.
In a statement to the station, officials at the medical center said they “immediately removed all materials and containers” from the examination room and sanitized the entire facility.
The incident is the latest in a disturbing trend of people caught on video licking products, such as ice cream, and then returning it to shelves.
