Tariffs Ruling 'Judicial Coup'

On Wednesday, the Court of International Trade said the U.S. Constitution gives Congress exclusive authority to regulate commerce with other countries that is not overridden by the president’s emergency powers to safeguard the U.S. economy.

Section 232 allows the President to impose import restrictions based on an investigation and affirmative determination by the Department of Commerce (Commerce) that certain imports threaten to impair U.S. national security.

The Donald Trump administration spent years slapping tariffs on Chinese goods, using a lot of the same arguments the Biden administration is now making: that China’s trade policies are unfair, that the country is boosting its growth at the expense of others, that these tariffs are necessary to protect American industry and jobs. BUT NOT NOW ???
