The Constitution enumerates the federal government to have sole power over Interstate and Foreign Commerce, Currency, Post Offices, Patents and Copyrights, Armed Forces, War and Immigration. The Constitution also includes the Elastic Clause, which gives Congress the power to make any laws “necessary and proper” to carry out its enumerated powers. The 10th Amendment grants to the States and the People powers for all other things not forbidden to it by the Constitution. The state and Local governments not only have no legal authority over Immigration, they have not right to interfere with the federal government’s authority to control it, including the deportation of immigrants who violate federal immigration or state and local criminal laws. State and local Sanctuary Laws cannot be used to prevent the federal government exercising its authority over immigration.
