I am sure none of you realize this, but as a matter of law, the Supreme Court gets the final say on constitutional questions because it assumed that position for itself and as a subsequent matter of custom, not because the Constitution actually requires it. The custom has prevailed out of concern for creating constitutional crises, but if Congress wants to assert a basis upon which it can override the Supreme Court there’s no constitutional impediment to its doing exactly that.

I think you are all declaring victory before the fight has even started, which is fine with me. I love watching how demoralized all of you get when you lose (which is frequent).

This Constitution began with granting only some people full rights; everyone else was second-class or without rights at all. This everyone else includes women. Then Constitutional amendments granted everyone equality.

What is the meaning of such an amendment? It has to mean that all previous legal precedent concerning, e.g., women’s rights, are void. It can’t be that “you are equal, but when a right of yours is in doubt we cite laws from an era when you weren’t equal to figure out what your rights mean”. It would mean that every single right would have to be enumerated and legislated or else your rights are at the mercy of anyone who wants to bring up ancient history. “You are equal but unequally carry all the burden of an unequal past” – does anyone believe that is what the amendments mean?

To interpretation of the Constitution neither women nor non-white people can owe any allegiance to – which may be the one of the purposes of this illegitimate and corrupt Supreme Court. The correct reply to that is we keep the Constitution and boot out these bastards.

That’s disgusting and will never hold up in court. The sheriff (who is mobilizing his voting base) would be facing stiff criminal and civil penalties if he even attempted to enforce this.

No where in the constitution does it say abortions are legal and a constitutional right. It never was a right and it still isn’t. Roe/Wade was a bad ruling from the start and it should have never been allowed. The SCOTUS made the correct ruling!

Our side, as it were, does not engage in the same sort of historical fiction or selectivity when deciding what parts of the nation’s legal history represent the views of the time or can be dismissed as irrelevant (because they weigh against what the court wants to do), because it is not dedicated to an originalist / textualist approach to interpretation that is chosen not because it has a valid intellectual basis but because it makes it easier to pursue a regressive, reactionary agenda.

Being less willing to pursue the fiction that we can clearly and consistently determine what the text of the Constitution meant at the moment of ratification, or that we can similarly know what was intended by the text at that time, provides the basis for right-wing accusations that Democratic appointees are “activist”. But the Republican appointees use their cherry-picked amateur histories to justify reading the language of the Constitution in the manner that they want. It’s more honest to say, “The Constitution’s language is unclear, and that lack of clarity provides latitude for interpretation consistent with the needs and understandings of the time, as opposed to trying to constrain interpretation based upon something that is unknowable”, than to pretend to know the unknowable (which, as it turns out, just happens to be both very conservative and what the textualists / originalists wanted to do in the first place).

Personally I think all so called pro-life people should be required to watch Call the Midwife - all episodes, all seasons. It’s really the best dramatic depiction of the pertinent issues, presented in an accessible format. Watching it myself, I was struck by the frank way they depicted the human struggles, including watching the nuns examine/re-examine their convictions.

Then there’s all the polling data and published stories that clearly show a large number of pro-life people believe it should be illegal “except for me”. Stories about women who literally leave the pro-life picket line to go get an abortion (because their own case is special) then go back to the picket line. And pro-life men who pay for abortions for their mistresses. It’s phenomenal. Maybe they want to make it illegal so they themselves would be prevented from doing it. They hate themselves. It’s similar to the vocally anti-gay politicians who we later learn are gay.

Yeah, and I think you should try explaining that to people who choose not to get vaccinated as in “My body my choice,” but you have to perform mental gymnastics to explain that away from looking like the hypocrites that the left has always been.

I am pro-abortion, in that I believe that abortion should be absolutely available to anyone who wants to get one, and that in essentially all cases in which someone chooses to get one, that is a good result.
