Whether the constitution demands it or not to me is completely irrelevant. If they are illegal we need to know it. If they admit it, fine, if they refuse to answer we have plenty of reason to assume they are and apportionment should be determined accordingly.

Usually a tourist Visa is 90 days traveling to the US. What amazes me, while having traveled many countries myself is that if you over stay your Visa you get hit with a stiff financial penalty each day one stays past their expiry date! From my understanding the US has very lenient policies regarding tourist visas and this is just one aspect of many that contribute to the number of illegals currently in the country! Our immigration laws seriously need to change to address the rampant abuses that has been happening!
One thing we have to add is visa holder tracking and enforcement.
We only have a total though of about 8000 ICE agents to deal with all interior enforcement so that would be something like 5,000-50,000 illegals and visa overstays for each agent in the field to catch.
The numbers make it completelly impossible.
We need to hire about a hundred thousand agents for interior enforcement and add probably 2000-5000 immigration courts to begin to even get a handle on it.
Well just think about this in comparison, and of course you are right and bring up some very good points, China having 3X the population size don’t have a problem with Visa overstays, of course it could be argue that less people want to stay in China, but having been through their immigration system they run a pretty efficient system and have a no tolerance policy regarding Visa overstays. We need to start changing some things to make it about no tolerance that acts as a deterrent!
