Federal Judge Blocks 2020 Census Citizenship Question

Seems this Judge was having non of Wilbur Ross’s nonsense.

A federal judge for the U.S. District Court for the Northern District of California unloaded on the attempted inclusion of a citizenship question on the 2020 Census, calling Secretary of Commerce Wilbur Ross ‘ decision “arbitrary and capricious.”

U.S. District Judge Richard Seeborg awarded a nationwide injunction to the plaintiffs–the State of California and the City of San Jose–in a massive 126-page order, which concluded that the inclusion of the question violated the Administrative Procedure Act (APA) and the Enumeration Clause of the Constitution.

At the very end of the tome, Seeborg added an “in short” that got to the heart of the matter.

“In short, the inclusion of the citizenship question on the 2020 Census threatens the very foundation of our democratic system—and does so based on a self-defeating rationale,” he said. “In light of these findings, Defendants do not get another bite at the apple. Defendants are hereby enjoined from including the citizenship question on the 2020 Census, regardless of any technical compliance with the APA.”

Judge shopping- this will be overturned higher up.

That’s some serious ■■■■■ right there. So when do the supremes get their chance to show non-partisanship?

They hear the case in April, but with more opinions this concise (there are 2 now) it makes their overturning it that much harder. (by that I mean reinstating the question…overturning the lower court)

Libs are absolutely desperate to let the illegals influence our government. Eventually, we’ll get an elected congressman who does not speak english.

Yes this isn’t even new news. The SCOTUS already has agreed to move up the date for this case in order to listen to oral arguments due to the elections being so close, which in the bigger picture will have ramifications for the Democrats should they lose at the Supreme Court level and this gets overturned. This is not over by any stretch! Stay tuned!

The Trump administration, though, announced last month that it would directly ask the Supreme Court to overrule the federal court judge, who said in a court opinion that such a question would dramatically reduce the response rate—and congressional representation—of non-citizens.

The judge, though, ruled that while a question on citizenship would be constitutional, U.S. Commerce Secretary Wilbur Ross had added it arbitrarily and did not follow proper procedure. Among other things, the judge said that Ross didn’t follow a law requiring that he give Congress three years notice of any plan to add a question about citizenship to the census. That ruling came in a case in which a dozen states or big cities and immigrants’ rights groups argued that the Commerce Department, which designs the census, had failed to properly analyze the effect the question would have on immigrant households.

The Commerce Department, last May, said in a statement that the citizenship question would be added to the 2020 census count in response to a request made by the Justice Department in December 2017. The statement said that Ross had “determined that reinstatement of a citizenship question on the 2020 decennial census questionnaire is necessary to provide complete and accurate census block level data.”

Onward and upward to the SCOTUS.

And we already know how Roberts , Kagan , Breyer, Sotomayor, and Ginsburg will vote !!!

Roberts not so much.

Roberts as the chief justice struggles to maintain the courts unbiased position forcing him into the swing vote position.

The ACA was the perfect example.

He chose to side with the dems via renaming a fee to a tax. He further stated that if voters didn’t like it they should vote accordingly. They did and the right failed miserably in ending the ACA as the media and left changed the narrative from ending the ACA to end and replace.

Clearly people are disgusted with the GOP and their congressional record as they dumped the House representatives. Unfortunately they were replaced with the dems which is clearly proving to be one of the most polarizing moves in recent history.
