Fast forward to Trump, and for the first time this practice is being challenged in court. Given that DEMs and Republicans use this device on a regular basis, what happens if the courts rule against Trump? Trump’s argument would likely highlight the widespread abuse.
If that practice is deemed unconstitutional by the courts, wouldn’t that prevent its use for everyone going forward? Everyone loses, but hey Trump was stopped.
